1. Acceptance and Eligibility

By accessing or using the InsureGenie platform ("Service"), you ("User") agree to be bound by these Terms of Service ("Terms"). If you do not agree, you must not use the Service.

InsureGenie is an AI-powered insurance education and advisory platform. We help Indian users understand their existing policies, evaluate new insurance options, track renewal dates, assist with claim processes, and make more informed insurance decisions.

6. Intellectual Property

We will never prevent you from purchasing directly from an insurer. Our facilitated purchase flow is a convenience, not a gate. You always have the option to purchase directly from the insurer's website or through their licensed agents.

All affiliate arrangements are maintained in compliance with IRDAI's guidelines on insurance marketing. Where required, disclosure of compensation arrangements is provided as mandated by regulation.

8. Limitation of Liability


8.1 "As Is" Service

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.


8.2 Specific Exclusions

We are NOT liable for:

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE INDIAN LAW, OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING FROM USE OF THE SERVICE SHALL NOT EXCEED THE GREATER OF: (A) FEES PAID BY YOU TO US IN THE TWELVE MONTHS IMMEDIATELY PRECEDING THE CLAIM, OR (B) ₹10,000 (RUPEES TEN THOUSAND) for free-tier users.


8.4 Consequential Damages Excluded

We are not liable for: indirect, incidental, special, consequential, punitive, or exemplary damages — including but not limited to loss of profits, business, data, goodwill, or anticipated savings — even if we have been advised of the possibility of such damages.


8.5 Insurance Contracts

The legal relationship governing any insurance policy is between you and the insurer, governed by the policy document, Indian insurance laws, and IRDAI regulations. We are not a party to that relationship and bear no liability for any aspect of it.


> Note to our legal team: These limitation clauses must be reviewed for compliance with the Consumer Protection Act 2019, which may restrict the extent to which liability can be excluded for consumers. Limitation clauses may be unenforceable if deemed "unfair" under consumer protection law. Please advise on appropriate language and any required carve-outs.

11. Dispute Resolution


11.1 First Step: Amicable Resolution

Before initiating any formal proceedings, you agree to first contact us at legal@insuregenie.in describing your dispute in detail. We will use reasonable efforts to resolve the dispute within 30 days.


11.2 Grievance Redressal

For formal complaints, use our in-app grievance mechanism or contact our Grievance Officer (details in Section 14). Grievances will be acknowledged within 24 hours and resolved within 30 days (15 days for data-related grievances under DPDPA).


11.3 Mediation

If amicable resolution fails, both parties agree to attempt mediation before litigation, through a mutually agreed mediator or the Indian Council of Arbitration (ICA).


11.4 Governing Law and Jurisdiction

These Terms are governed by the laws of India. Any dispute not resolved by mediation shall be subject to the exclusive jurisdiction of the courts in [City — to be specified before launch], India.


11.5 Class Action Waiver

To the extent permitted by applicable law, you waive any right to participate in a class action or representative proceeding against us. You may only bring claims in your individual capacity.

If any provision of these Terms is found invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision will be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. All other provisions remain in full force and effect.

15. Acceptance Mechanism


15.1 Click-to-Accept

These Terms require explicit acceptance via checkbox at account creation. Using the Service without acceptance is not permitted.


15.2 Acceptance of Updates

For material changes to these Terms, we will require fresh acceptance via in-app notification. For non-material changes, continued use after the effective date of revised Terms constitutes acceptance.
